Bottle Consignment Agreement


Consignment Agreement used when a collector wants Reggie Lynch to sell their bottle(s) for them.

  1. Seller (that's you) agrees to consign the following bottle(s) with Dealer (Reggie Lynch) for the purpose of auctioning or selling the bottle(s). Dealer will sell/auction the bottle(s) with proceeds going to Buyer minus 15% commission retained by Dealer. Seller decides if Dealer can:

  4. Note that the "Reserve Price" is the minimum price that the Dealer will sell the bottle for to a Buyer. The 15% commission comes out of the final selling price.

  5. Seller is responsible for safe delivery of bottle(s) to Dealer. This usually involves sending a carefully packed box that is insured/registered. See Bottle Packing Tips.
    In some cases, local pickup can be arranged if you live near one of the many bottle shows that Reggie attends along the east coast and midwest.

  6. Upon receipt of bottles, Dealer will inspect bottle(s) to insure they meet the description. At this point, the Dealer will either accept the bottles (if as described) or return them to the Seller (if not as described). Typically the only reason a bottle would be returned is if it has some damage that Seller failed to see. Bottle collectors are very picky about the condition and it has a great impact on price. Dealer will use a black light to inspect bottle for hidden epoxy repairs.

  7. Dealer may advise having the bottle professionally cleaned. Doing so typically increases the value of dirty bottles. While professional cleaning is almost always safe, there have been instances where the bottle is damaged in the cleaning process. While the Dealer will act in good faith to insure the bottle is safely cleaned, the Seller assumes all risk for the cleaning process. This is because no bottle cleaner will give a guarantee. The cost of cleaning the bottle will be deducted from the price realized before check sent to Seller.

  8. Dealer will carry insurance to cover the appraised worth of the bottle(s) while it is in the dealer's possession. While insurance covers theft, loss and accidental damage, it does not cover damage that may result from professionally cleaning the bottle (see item above).

  9. If auctioning the bottle(s), dealer will commence auction within 5 days of receiving bottle(s). Auction duration is 10 days, and all auction fees are paid by Dealer. If Seller requests, a reserve price will be set for the bottle(s).

    If Seller agrees to let Dealer promote the bottle first so the right Buyers know its coming to market, then the 5 days to start the auction does not apply. Instead, the Seller and Dealer will agree on an appropriate promotion period.

  10. If reserve price is met at end of auction, then Dealer will handle receiving payment from Buyer and sending the bottle to the Buyer with a 3 day buyer satisfaction guarantee. If Buyer is satisfied, then Dealer mails a check to Seller for the final auction price (excluding postage) minus the 15% commission and minus any cleaning fee. For example, if bottle auctions for $100, then the Seller will be paid $85.

  11. If Buyer returns bottle (i.e. was not satisfied), then Dealer has option of trying to sell the bottle to one of the runner-up bidders for a price that may be slightly less but will be above any set reserve price.

  12. If bottle(s) does not meet the reserve price, then Dealer will check if Seller wants to sell it for a lower price or rerun the auction one more time. If bottle does not sell, then Dealer will return the bottle to the Seller.

  13. If bottle(s) is put up For Sale rather than being Auctioned, then the Dealer will use whatever means to get the reserve price or higher for the Seller. These "means" include, but are not limited to: Dealer will continue trying to sell the bottle until A) bottle is sold or B) Seller asks for bottle to be returned.

Seller should read the above agreement, fill in the info for each bottle being consigned, and Email/mail the form to Dealer. Upon receipt, Dealer will review form and notify Seller if terms are acceptable. Seller should NOT send the bottle(s) until the Dealer agrees to the terms.
